AI Terms

- Access to AI. Builder provides and makes available the AI to Customer pursuant to the terms and conditions that apply to the Services in this Agreement. “AI” means artificial intelligence technology, whether proprietary to Builder, a third party, or open source.
- Input and Output. Customer may provide or submit Customer Data to the AI (“Input”), and receive images, code, materials, files, and other content generated and returned by the AI based on that Input (“Output”). As between Builder and Customer, Customer will retain sole ownership of the Input and Output. The term “Customer Data” is defined in Section 4.2 of this Agreement. Builder may use the Outputs to provide the Services to Customer.
- Restrictions. Customer will not: (a) use the AI to create, train, or improve a similar or competing foundation or large language model or other generative artificial intelligence service that competes with Builder or the applicable AI, (b) reverse engineer, extract, or discover the AI’s data, models, model weights, algorithms, safety features, or operation, (c) modify, tamper with, remove, obscure, or otherwise alter any metadata, digital signatures, or watermarks that identify Output as generated using a generative artificial intelligence model; (d) use the AI in a manner that violates any terms of any third party identified on this page: https://www.builder.io/c/docs/ai-use#where-builder-uses-ll-ms or (e) use the AI or Output to (i) mislead any person, including by misleading any person to believe that the Output was human-generated, or (ii) make automated decisions that may have a detrimental impact on individual rights.
- Training the AI. Builder uses the AI to improve the Services by training machine learning and artificial intelligence algorithms and models. Builder may use Customer Data to train and improve the AI if the customer is on a free plan or, for customers on self-service accounts, if AI Training is toggled ON within your account settings. Builder will not use Customer Data of Enterprise customers to train and improve the AI. In connection with Builder's use of the AI and Outputs in the Services, Builder represents and warrants to Customer that: (a) Customer Data is not capable of being viewed or leveraged by other customers of Builder; (b) Builder will not knowingly submit to the AI any personal information of Customer; and (c) Builder will not store Customer Data provided to the AI, except as necessary for purposes of debugging and fixing errors in the Services that are provided to Customer.
- Disclaimers. Customer acknowledges and agrees that Output is generated by artificial intelligence and accordingly Outputs are provided by Builder without any representation, warranty, guarantee or indemnification obligation by Builder. In addition, Builder makes no warranty or guarantee as to the accuracy, completeness, or reliability of Output and will not be liable for Customer’s use of Output or any omissions or errors in Output. Customer is responsible for evaluating Output, including evaluating Output for accuracy, completeness, reliability, non-infringement of third party intellectual property, and compliance with applicable law, including by employing human review of Output. To the extent any disclosures to individuals are required with respect to Output being generated by artificial intelligence, Customer is responsible for providing such disclosures to individuals.
- Similar Outputs. Customer acknowledges and agrees that, due to the nature of artificial intelligence, Output may not be unique and the AI may generate the same or similar output for other customers. Customer will not pursue or maintain any claim against Builder or any third party arising from or related to any Output generated by the AI or any output generated by the AI that is similar to any Output.
